Types of Dog Bites

Professionals usually refer to Dunbar's Dog Bite Scale to determine how bad a dog bite is. This scale breaks down bites into six levels of severity:

  • Level 1: There's no contact between the dog's teeth and the skin. This means that the dog did not actually bite the person, even though it may have shown aggressive behavior.

  • Level 2: The dog's teeth make contact with the skin but do not break it. In this case, the bite may have caused a slight bruise that did not puncture the skin.

  • Level 3: The skin has one to four shallow puncture wounds, and the punctures are not deeper than half the length of the dog's teeth. This could be caused by defensive behavior.

  • Level 4: The skin has one to four punctures from a single bite, with at least one puncture being deeper than half the length of the dog's tooth. From this point, dog bite victims may be eligible for a settlement.

  • Level 5: There are multiple bites, including some deep puncture wounds. This means that the dog might have attacked the person multiple times and caused multiple injuries.

  • Level 6: Dog bites at this level fatally injure the victims and lead to death.

The Legal Responsibilities of a Dog Owner

In Tennessee, dog owners are required by law to keep their dogs under control and keep them from going loose or causing injury to others.

If the dog causes injuries to someone while running loose in public or on another person's property, the owner will be held accountable.

In addition, a dog owner must also provide needed barriers and keep the dog under control, especially if it's aggressive. This can be done by leashing or chaining the dog to prevent it from making contact with people and harming them.

If the owner is aware that the dog is aggressive, they must warn their neighbors and others who may come into contact with the dog.

Tennessee Dog Bite Law

In Tennessee, dog owners may be held liable for damage caused by their dogs to anybody on public or private property. This liability applies even if the dog has never displayed aggressive behavior before.

However, this law has some exceptions. An example is if the dog inflicting the injury is a police-issued or military dog, and it happens while the dog is on duty.

Another example is if the owner has made sure that the dog was properly restrained, such as in a cage. Additionally, the exception related to the liability of a dog owner may also apply if the dog was being harassed or provoked or trying to protect its owner from danger.

There is also a part of a new law that states that if a dog injures a person on the dog owner's residential, farm, or other non-commercial property, the owner may not be held responsible. However, the victim can still hold the owner liable if they manage to prove that the owner knew or should have known about the dog's dangerous tendencies.

Regardless of those exceptions, it's always important for dog owners to take appropriate measures. Preventing their dogs from causing harm to others will help avoid more problems in the future.

What to Do After Getting Dog Bite Injuries

Sustaining a dog bite injury may be a traumatic experience. If the victim is seriously injured, the first thing they need to do is get medical treatment. The types of serious injuries include but are not limited to puncture wounds, fractures, or extensive scarring.

A dog bite victim can also file a case if the injury affects their life significantly. They can get help from a Nashville dog bite attorney to seek compensation for their pain, lost income, reduced quality of life, or disability due to the dog bites. In Nashville, dog bite lawyers will also help victims understand their legal rights and get the amount of compensation they deserve.

Furthermore, it's also important for dog bite victims to report the incident to the authority, such as the local animal control agency or police. Animal control may conduct an investigation and take necessary action, such as impounding the dog.

If the incident is documented by the authorities, it can be used as evidence to support the victim's case and demonstrate that the dog has a history of aggressive conduct. Furthermore, reporting the incident will help prevent similar events from happening in the future by identifying any patterns of aggressive behavior in the dog.
